I have spent countless hours learning how speed measuring devices work. I have questioned hundreds of officers about how they have been used incorrectly. I’ve questioned every Speed Measuring Device Expert that the Washington State Patrol employs. I have read the manuals of the devices used by the Washington State Patrol and police departments across the state of Washington. I’ve argued thousands of traffic tickets and, in the course of those cases, learned the ways that speed measuring devices are used incorrectly or can malfunction. Understanding how these devices can be used incorrectly or how they lack reliability has led to thousands of dismissed traffic tickets.
Beating a Speeding Ticket May Mean Using an Attorney
You CAN beat a speeding ticket on your own. Just like you can fix your own electrical or your own plumbing. It can be done, but the risks to getting it wrong can be enormous. Most people aren’t aware of the many pitfalls that traffic tickets can create. Many people are unaware of the costly effects moving infractions have on your insurance.
Speeding tickets are issued under RCW 46.61.400. In this article, I will go over several examples of speed measuring devices being used incorrectly. Sometimes, the officer doesn’t even know they’ve made a mistake while using the speed measuring device. Which means they will issue you a ticket! Sometimes, the officer knows that they’ve used the device incorrectly and will STILL issue you a ticket. Beat a Speeding Ticket by Challenging the Speed Gun’s Reliability
How do you beat a speeding ticket by challenging the speed gun? Let me go over a few examples: first speed measuring devices need to be calibrated either every year or every two years in the state of Washington. Different cities and counties have different requirements about WHEN the speed measuring device needs to be calibrated. Calibrating a speed device means that the speed gun is sent to a center where a group of experts that have read the manual test whether the device is in working order. This is a requirement, but judges sometimes overlook when a speed measuring device is no longer within a valid calibration period and will find your ticket committed anyways. Most people are unaware of the requirement that the certificate of calibration is filed with the court.
Beat a Speeding Ticket by Challenging How the Speed Gun was Used
Second, a speed measuring device may be faulty because of how it is being used. In other words, the officer could be using the speed measuring device incorrectly; both radar guns and laser guns have a range. The range of these guns determines how far accurate readings can be taken. Radar guns have a much shorter range than laser guns. Radar guns require the trooper or officer to set the range correctly in order to get an accurate reading. If the range is not set correctly then the officer could be taking a reading from much further behind a vehicle or much further in front of a vehicle instead of the vehicle they are trying to read. Laser devices have a much longer effective range and are more accurate in taking readings over long distances.
These are only two examples of mistakes that are made when officers use speed measuring devices including radar guns and laser guns to read the speed of passing motorists.
