DUI is a criminal offense. You have the right to demand that the State prove the charges against you at trial. If you are not in custody, Washington allows you to have a speedy trial within 90 days. 60 days for those who are. Six members of the public can sit with you during the trial to decide whether or not you are guilty. Washington law requires that juror verdicts be unanimous. This means that all members must agree to the verdict. The state must prove guilt beyond reasonable doubt.
The State will call witnesses, including the arresting officer or a state-certified toxicologist, to testify in the trial. The defense will be allowed to call any witnesses, including our experts, after the State has laid its case. You are presumed innocent throughout the trial. If the State does not prove their case beyond reasonable doubt, we may not call any witnesses.
