DUI Deferred Prosecution

A person charged with Washington misdemeanors and gross misdemeanors can apply for the Deferred Prosecution Program. RCW Chapter 10 explains the program. The successful completion of this program can help a defendant avoid a conviction and all the associated penalties. The defendant must swear that the crime was caused by alcohol, drug use, or mental problems. The likelihood of the crime recurring is high if the defendant does not receive treatment. Washington prohibits deferred prosecution for more than one offense in a lifetime.
