You should have received paperwork stating that you have seven days from the date you were arrested to request a hearing to challenge your license suspension if you are charged with DUI. For the hearing, the Department of Licensing charges you with a $375 non-refundable fee. If you are in financial hardship, the DOL might waive the $375.

Within 30 days of your arrest, you have the right to a hearing. The hearing can be conducted by phone. It involves a hearing officer appointment by DOL who will review the report of the arresting officer and any defense evidence. If requested by the driver, the police officer will attend the hearing.

These are the issues that the hearing officer will address:

No matter if you were in lawful detention

If the officer had reasonable grounds for believing that you were driving, or in actual physical control, of a motor car while under the influence or any other drug.

Whether you were given the right information under RCW 46.20.308(2)

Whether or not you refused to take a test.

Your license will be suspended if the hearings officer finds the police officer followed the law. If your attorney points out any mistakes made by the police and provides evidence, the DOL will not suspend you license.
